A pensão alimentícia é devida ainda que o menor passe as suas férias escolares com o pai.
Se sabe que a pensão engloba todos os gastos com alimentação, lazer, medicamentos, mensalidade escolar, energia, água, entre outros custos necessários para a manutenção e sobrevivência da criança e do adolescente. O fato de o filho estar passando o período de férias escolares com o pai, não exclui as responsabilidades quanto ao pagamento destas despesas.
Não há na lei nenhuma previsão de redução da pensão alimentícia neste período de recesso. Por isso, o genitor não pode simplesmente deixar de pagar ou reduzir o pagamento dos alimentos sem que tenha uma decisão judicial autorizando-o.
Caso o genitor não arque com a pensão em seu valor integral, é necessário informar para o juiz de forma imediata, cabendo inclusive pedir a prisão civil do devedor alimentício.
