Hoje nós vivemos em um mundo tecnológico e cada dia mais virtual. Por conta disso, surgiu um instituto denominado herança digital, que corresponde à todos os bens, criptomoedas, milhas aéreas, redes sociais, NFTs e demais bens ou direitos que estejam guardados em nuvens ou plataformas digitais. Em outras palavras, tudo aquilo que exista virtualmente e seja de propriedade de uma pessoa.
Herança é tudo aquilo que pertencia ao falecido e que será transmitido aos seus herdeiros. Por se tratar de um tema novo e atual, a herança digital ainda não está prevista em lei, mas há um projeto de lei tramitando na Câmara dos Deputados, que fixa regras para provedores de aplicações de internet tratarem de perfis, páginas, contas, publicações e dados pessoais de pessoas falecidas. O projeto inclui também disposições no Código Civil e na Lei de Direitos Autorais (9.610/1998).
Por ser uma novidade ainda não prevista em lei, é indicado que seja disposto em testamento a transmissão desses bens digitais, para que seja resguardado a última vontade do falecido e assim assegurar a sua intimidade e privacidade.
