Após decisão do STF, valores decorrentes de direito de família, como pensão alimentícia, não são mais tributados, devendo, portanto, ser declarados como valores não-tributáveis no imposto de renda.
Receita Federal esclarece que os valores recebidos de pensão alimentícia não são mais tributados pelo imposto de renda. A decisão do STF de afastar a incidência do imposto sobre esses valores, decorrentes do direito de família, foi publicada no dia 23 de agosto, na ADI n° 5422.
Quem nos 5 últimos anos (de 2018 a 2022) apresentou declaração, incluindo esse valor como um rendimento tributável, pode retificar a declaração e fazer o acerto.
A declaração retificadora, referente ao ano de exercício do recolhimento ou retenção indevidos, pode ser enviada por meio do Programa Gerador da Declaração, no Portal e-CAC, ou pelo aplicativo “Meu Imposto de Renda”. Para isso, basta informar o número do recibo de entrega da declaração que será retificada e manter o modelo de dedução escolhido no envio da declaração.
